VINYL-LITE WARRANTY
Purchaser’s signature affixed to the original contract attests to the acceptance of the products and description of work and payment schedule described, and credit (if applicable) has been extended in strict reliance upon receipt of all information required by Vinyl-Lite from the Purchaser. Purchaser further agrees to authorize Vinyl-Lite to obtain credit information or perform credit check as applicable to all contracts being finance by Vinyl-Lite. In the event legal action is instituted to enforce payment of any amount due, Purchaser agrees to pay any and all reasonable amounts identified by Vinyl-Lite in payment of attorney’s fees and/or legal costs incurred by Vinyl-Lite. Purchaser further agrees to pay interest at a rate equal to 1 1/2% per moth on all past due amounts. All materials and work to be accomplished are to be used and performed at the address or location shown on the original contract. All co-signers, guarantors, or co-purchasers agree to be bound equally by the terms and conditions set forth in this agreement.
All merchandise and work performed shall be inspected by the Purchaser upon completion of said work, and any and all errors or irregularities that exist must be reported immediately. If this not possible, then within five (5) days after completion of said work, otherwise no claims or adjustments of any kind will be considered. All doors (entrance, patio doors, French doors or storm doors), are to be considered to be of stock size unless specified otherwise on the purchases Original Agreement. Unless specified in writing on the reverse side of the Original Purchase Agreement products are not suited for use in coastal areas or areas prone to hurricanes or tornado activity. Vinyl-Lite assumes no responsibility for any consequential damages resulting from any irregular or defective components associated with or connected with the residence or structure pertaining to the installation thereof. If a conflict ever arises between Vinyl-lite and the Purchaser, the Purchaser agrees to resolve the dispute via the BBB and further agrees not to dispute claim through credit card companies. Vinyl-Lite is not responsible for the availability or loss of tax credits.
Any error (s) incorporated in or appearing on this document are subject to correction without prior notice to Purchaser. The person signing this form on behalf of another person, company, or corporation warrants that he/she is authorized to do so and further agrees he/she is jointly and severally liable with the individual, company or corporation for any indebtedness owed to Vinyl-Lite. Please see any additional terms and conditions at vinyl-lite.com/termsAll prices including delivery terms, are subject to change to those in affect in the time of shipment or pick-up of merchandise, without notice. If a product becomes unavailable in the future, Vinyl-Lite reserves the right to substitute same.
Any terms and conditions other than contained herein or additional terms and conditions proposed by the Purchaser in variance to the terms and conditions of this contract are not binding unless accepted in writing by Vinyl-Lite. It is further understood that no verbal Agreements are acceptable. Everything expected by the Buyer to be provided or performed by the Seller is included in writing within this Agreement. Modifications, alterations, representations or promises must be in writing, accepted and agreed upon by both the Seller and the Buyer. It is understood and hereby agreed to that under no circumstances will Vinyl-Lite be responsible for improper installation of the merchandise by the Purchaser or any third party. Vinyl-Lite is not responsible for window wells or leaks. Purchaser agrees to acquire yearly exterior water leak prevention inspection. Any and all defective removable merchandise must be returned to Vinyl-Lite for repair or replacement. Other manufacturer’s warranty will apply to all products sold by but not manufactured by Vinyl-Lite. Please check to see which warranty applies to your purchase.
By signing contract you are signing a personal guarantee for full payment, regardless if you sell the property.
Deposits in connection with any orders of any description are non-refundable with no exception.
Purchaser agrees to allow Vinyl-Lite to display job sign in plain view from the street on premises for a period of thirty (30) days from date of installation. Purchaser further agrees to allow Vinyl-Lite to use photos and the job itself as reference.
Purchaser’s Right to Cancel: If this Agreement was solicited at a residence and you do not want the goods or services, you, the Purchaser, may cancel this transaction in writing at any time prior to midnight of the third business day after the date of this transaction, without penalty.
Limitations
Vinyl-Lite’s Lifetime Warranty applies only to the 4000, 7000, 8000 and 9000 series windows and does not apply for Dark Brown windows or custom colors.
WOOD – Existing molding and frame will remain unless otherwise specified. If any wood must be replaced or installed, it will be paint grade finger joint, unless otherwise specified on the reverse side of the Original Agreement.
PAINTING—Windows that are painted carry a 10 Year Limited Warranty against peeling, blistering & pitting from the date of installation. Vinyl-lite does not assume responsibility for paint that has been altered, added, removed and/or brought from it’s original state.
PLASTER—Vinyl-Lite is not responsible for plaster falling out around window openings.
PANS—If panning system remains, Vinyl-Lite is not responsible for cracks or poor appearance of sealant or plaster falling out.
TILE—Vinyl-Lite is not responsible for the replacement or repair of any tiles that may crack around a window during removal of old window or installation. Purchaser assumes full responsibility for repair or replacement and payment for same.
BLINDS/CURTAINS—Vinyl-Lite will not remove or reinstall blinds or curtains. If Vinyl-Lite does remove blinds, it is only a courtesy and does not assume any responsibility. Under no circumstances will Vinyl-Lite reinstall blinds. Some blinds may not fit back inside window opening. Purchaser assumes responsibility for procuring outside mount and installation.
PATIO DOOR SCREEN—After installation, Purchaser is responsible for all minor adjustments. SILLS—Some loss of sill space may occur with new replacement windows depending on type of installation.
GRIDS—Grids will be standard pattern unless otherwise specified on reverse side of the Original Agreement. regardless of what is presently existing in windows. Grid notching on grids is randomly overlapped. Pattern description V+Vertical Bars and H=Horizontal Bars.
HEAD EXPANDERS—Series 7000, 8000 and 9000 style windows come equipped with head expanders, in contrast the 4000 series style windows do not come with head expanders.
BOWS/BAYS—All bows and bays will be finished to soffit unless roof is specified on reverse side of the Original Agreement.
Vinyl-Lite is not responsible for cost of removing electrical service, vents, plumbing or any other mechanical devices.
BLUE PRINTS—Vinyl-Lite personnel are not responsible for the interpretation of specifications or blue prints (prior plan review is offered by Vinyl-Lite as a courtesy free of charge).
PERMITS—Unless so specified on the reverse side of the Original Agreement as a requirement, any and all permits, associations, homeowner or historical approvals are to be obtained by the Purchaser, if required.
ALARMS—Purchaser must notify salesperson regarding the existence of an alarm system assumes all responsibility for removal and/or reinstallation.
DUST AND DEBRIS—Vinyl-Lite will remove trash associated with their job and clean job site inside and out. Purchaser is responsible for all final vacuuming and clean up of any remaining debris.
ENTRANCE DOORS PRIMED FOR PAINTING—Vinyl-Lite is not responsible for painting.
STORM DOORS AND GARDEN WINDOW COLORS ARE NOT EXACT COLOR MATCH TO WINDOWS.
Exclusions:
This warranty does not provide protection against any failure, defect or damage caused by situations and events beyond normal exposure conditions including but not limited to:
A. Any damage to the product caused by impact of foreign objects, fire, earthquake, flood, lightning, hurricane, tornado or other casualty or act of God.
B. Defects, damage or failure caused by improper handling or storage, misuse, abuse, transportation or improper installation.
C. Windows or doors that have been altered by paint, varnish or any coating (other than by Vinyl-Lite) subsequent to the purchase.
D. Defects or damage caused by the effects of air pollution, mildew, exposure to harmful chemicals or normal weathering caused by exposure to the elements. Normal weathering is defined as exposure to sunlight and extremes of weather and atmosphere that will cause any colored surface to gradually fade, chalk or accumulate dirt or stains. The severity of any condition depends on the cleanliness of the air in the area and many other local influences over which Vinyl-Lite has no control. Vinyl-Lite shall have sole discretion to determine, based on reasonable criteria, whether the product has experienced normal weathering. In the event a product weathers to a degree determined by Vinyl-Lite to be beyond normal, Vinyl-Lite shall select, at its sole discretion, one of the options as set forth in the section of this warranty titled “Overview of Lifetime Limited Warranty.”
